PATERNITY ACTIONS
An increasing number of couples are having children without entering into marriage. In these cases, the court may need to declare the father to be the biological father of the child in order for the father to be granted parental rights and responsibilities regarding the child.
The rights and responsibilities of unmarried parents and their children are governed by the Illinois Parentage Act. Under Illinois law, the same standards regarding custody and allocation of parental responsibilities and child support that are applied to divorcing couples are applied to unmarried parents.
